Common use of Errors in Billing Clause in Contracts

Errors in Billing. If either Party hereto shall find after the date of any payment hereunder that there has been an overcharge or undercharge, the Party finding the error shall promptly notify the other Party in writing within twelve (12) months of the billing error. In such case, a Party owing an amount to the other Party due to the error shall pay the amount owed no later than thirty (30) Days after the Parties agree in good faith on the error and related amount owed.

In such casethe event of an under charge, a Party owing an amount to the other Party due to the error undercharged party shall pay the amount owed no later than thirty due within fifteen (3015) Days days after the Parties agree in good faith on receipt of the error and related amount owedinvoice correcting such error. In the event of an overcharge, the overcharged party shall refund the overpayment within fifteen (15) days of the receipt of the notice of error.
