Equitable Servitude Clause Samples
An equitable servitude is a legal obligation or restriction placed on the use of land that binds current and future owners, even if it is not formally recorded as a traditional property interest. Typically, it applies to situations where landowners agree to certain uses or restrictions—such as maintaining a shared fence or prohibiting commercial activities—that benefit or burden neighboring properties. The core function of an equitable servitude is to ensure that agreed-upon land use restrictions continue to apply over time, thereby promoting consistency and fairness among successive property owners and resolving potential disputes about land use.
