EQUIPMENT ASSIGNMENT. EQUIPMENT ASSIGNMENT. The following procedure shall apply to the assignment of equipment in the Public Service Division of the Department of Public Works:
A. When a piece of equipment becomes available for assignment, a notice will be posted in detail, five (5) working days prior to a meeting with Employees for the purpose of assigning this equipment and other affected equipment in accordance with seniority and the wishes of Employees.
B. Temporary assignment of equipment, however, shall be subject to the City's right to temporarily assign Employees in any given classification to any piece of equipment where the operational needs of the department require such assignment, as long as reasonable consideration is given to Employees who are normally assigned to such equipment.
C. To the extent possible, equipment shall be specifically assigned to an Employee. Multiple assignments shall be subject to agreement between the Union and the Employer.
D. When the City replaces an assigned piece of equipment, the Employee assigned to the vehicle being replaced shall be assigned to the replacement vehicle, provided the new vehicle is operated by Employees in the same classification level.
EQUIPMENT ASSIGNMENT. 7.2.1. In the event one of the Equipment Assignment Triggers listed in Section 1.6(ii) or 1.6 (iii) occurs during the Term and prior to payment in full of the Commission Cap, UniPixel may, at its sole option (i) pre-pay Commission in an amount equal to the then current Commission Cap less the total of all previously paid Commissions to Intel or (ii) assign all title and ownership to the Equipment to Intel; either payment or assignment must occur within thirty (30) days of such occurrence.
7.2.2. In the event that the Equipment Assignment Trigger listed in Section 1.6(i) occurs during the Term and prior to payment in full of the Commission Cap, Unipixel assigns all title and ownership to the Equipment to Intel.
7.2.3. In the event that UniPixel assigns ownership to the Equipment under either Section 7.2.1 or Section 7.2.2, UniPixel will then immediately permit Intel or its designee access to UniPixel’s facilities and property to remove any Equipment. UniPixel will further provide all necessary assistance to Intel or its designee to complete documentation to secure title and ownership to the Equipment at no additional cost.
EQUIPMENT ASSIGNMENT. During regular hours, employees will be assigned to a piece of equipment based on the employee seniority equipment qualifying list for that particular piece of equipment when that equipment is utilized. However, the Union agrees that the Department may deviate from the order of the employee seniority equipment list in assigning personnel when the Department deems it necessary for efficiency or practicality once assignments have been made and the crews have embarked on their work for the shift. Employees assigned to equipment at levels below the grade they have achieved will not lose any pay as a result of such lower assignment. New employees with the exception of employees at Grade 6 (Tradesmen) will be placed on all employee seniority equipment lists according to their seniority. However, employees possessing a valid commercial CDL A or B license will automatically be qualified on the dump truck and salt truck qualification lists. Employees possessing a valid commercial CDL-A license will automatically be qualified as Tractor-Trailer. Anything herein to the contrary notwithstanding, the determination of which employees (sewer crew or non-sewer crew) are to be assigned or called in to perform the cleaning of catch basins and culverts prior to or during a storm shall be at the discretion of the Department. In situations where the Sewer Crew personnel are split between jobs and one of the Sewer Crew members who is not the Sewer Crew Leader is given the responsibility of leading two or more personnel in accomplishing ‘sewer work’, such Sewer Crew member will be paid at the grade 4 rate.
