Common use of Entire and Sole Agreement Clause in Contracts

Entire and Sole Agreement. This Agreement supercedes and replaces the Plan of Reorganization and Exchange Agreement made and entered into on March 26, 1999 by and between ZOI, Xxxxx, and EKO. This Agreement constitutes the entire agreement between the parties and supersedes all other agreements, representations, warranties, statements, promises and undertakings, whether oral or written, with respect to the subject matter of this Agreement. This Agreement may be modified or amended only by a written agreement signed by the parties against whom the amendment is sought to be enforced.
