Common use of Enrollment Materials Clause in Contracts

Enrollment Materials. All enrollment agreements, forms and other materials, including Subscriber handbooks and identification cards, used for Contractholders and Subscribers shall be either PHS's or Guardian's existing approved forms, modified as necessary to reflect the terms of this Agreement, and the administrative requirements of PHS and Guardian, respectively. All such materials shall specify that PHS is the underwriter of HMO Plans, and that Guardian is the underwriter of Health Insurance Contracts (including the Out-of-Network Contracts) and Ancillary Products. Neither party will use enrollment materials reflecting this Agreement, or using the name of the other party, without the other party's approval.
