Engineered Performance. If the Goods fail to deliver the quoted engineered performance immediately following placement of Goods into service, Supplier shall reimburse Buyer for all costs associated with rearrangements, deloading of traffic and the like, which are required to reestablish the original traffic handling capacity of the facility. Supplier further agrees to reimburse Buyer for capital cost and expense required to establish engineered service levels.
