Common use of Enforceability in Jurisdictions Clause in Contracts

Enforceability in Jurisdictions. The Company and the Executive intend to and hereby confer jurisdiction to enforce the Restrictive Covenants upon the courts of any jurisdiction within the geographical scope of the Restrictive Covenants. If the courts of any one or more of such jurisdictions hold the Restrictive Covenants unenforceable by reason of the breadth of such scope or otherwise, it is the intention of the Company and the Executive that such determination not bar or in any way affect the Company's right to the relief provided above in the courts of any other jurisdiction within the geographical scope of the Restrictive Covenants, as to breaches of such covenants in such other respective jurisdictions, such covenants as they relate to each jurisdiction being, for this purpose, severable into diverse and independent covenants.

Enforceability in Jurisdictions. The Company and the Executive intend to and hereby confer jurisdiction to enforce the Restrictive Covenants upon the courts of any jurisdiction within the geographical scope of the such Restrictive Covenants. If the courts of any one or more of such jurisdictions hold the Restrictive Covenants wholly invalid or unenforceable by reason of the breadth of such scope or otherwise, it is the intention of the Company and the Executive that such determination not bar or in any way affect the right of the Company's right , or any of their Affiliates, to the relief provided above in the courts of any other jurisdiction within the geographical scope of the such Restrictive Covenants, as to breaches of such covenants Restrictive Covenants in such other respective jurisdictions, such covenants Restrictive Covenants as they relate to each jurisdiction being, for this purpose, severable into diverse and independent covenants.

If the courts of any one (1) or more of such jurisdictions hold the Restrictive Covenants wholly unenforceable by reason of the breadth of such scope or otherwise, it is the intention of the Company and the Executive Employee that such determination not bar or in any way affect the Company's right of the Company to the relief provided above in the courts of any other jurisdiction within the geographical scope of the Restrictive Covenantssuch covenants, as to breaches of such covenants in such other respective jurisdictions, such covenants as they relate to each jurisdiction being, for this purpose, severable into diverse and independent covenants.

If the courts of any one or more of such jurisdictions hold the Restrictive Covenants Protective Provisions unenforceable by reason of the breadth of such scope or otherwise, it is the intention of the Company and the Executive that such determination not bar or in any way affect the Company's ' s right to the relief provided above in these Sections 6 -11 in the courts of any other jurisdiction within the geographical scope of the Restrictive Covenantssuch Protective Provisions, as to breaches of such covenants Protective Provisions in such other respective jurisdictions, such covenants Protective Provisions as they relate to each jurisdiction being, for this purpose, severable into diverse and independent covenants.. 18

If the courts of any one or more of such jurisdictions hold the Restrictive Covenants unenforceable by reason of the breadth of such scope or otherwise, it is the intention of the Company and the Executive that such determination not bar or in any way affect the Company's right to the relief provided above in the courts of any other jurisdiction within the geographical scope of the Restrictive Covenants, as to breaches of such covenants in such other respective jurisdictions, such covenants as they relate to each jurisdiction being, for this purpose, severable into diverse and independent covenants.

If the courts of any one or more of such jurisdictions hold the Restrictive Covenants Protective Provisions unenforceable by reason of the breadth of such scope or otherwise, it is the intention of the Company and the Executive that such determination not bar or in any way affect the Company's right to the relief provided above in these Sections 5 - 10 in the courts of any other jurisdiction within the geographical scope of the Restrictive Covenantssuch Protective Provisions, as to breaches of such covenants Protective Provisions in such other respective jurisdictions, such covenants Protective Provisions as they relate to each jurisdiction being, for this purpose, severable into diverse and independent covenants.
