ENABLING POWERS. 3.1 This Agreement is made pursuant to Sections 101(5), and 113(1) of the Local Government ▇▇▇ ▇▇▇▇, Section 1(1) (b) of the Local Authorities (Goods and Services) ▇▇▇ ▇▇▇▇ and Section 1 of the ▇▇▇▇▇▇▇▇ ▇▇▇ ▇▇▇▇ (and all the other enabling powers). 3.2 It shall be the responsibility of each member to ensure they have the necessary delegations and decisions in place to give effect to this Agreement and by the act of entering into this Agreement have confirmed each of the Local London Members has met the requirements of this paragraph 3.2. 3.3 The general terms of the MOU are to be considered and approved by the Chief Executive of each of the Local London Members. The agreed MOU (The Appendix) and The Schedule as outlined in this agreement are to be signed by The Chief Executive for each of the eight Boroughs acting under delegated authority.

ENABLING POWERS. 4.1 This Deed is made pursuant to the provisions of Section 106 of the Act and shall constitute and shall be deemed to contain planning obligations for the purposes of Section 106 of the Act and in the event of a breach it shall be enforceable by the Council as local planning authority pursuant to all powers enabling and all enactments which may be relevant for the purpose of giving validity hereto or facilitating the enforcement of the obligations herein contained and shall bind the then Owner’s interest in the Off site Ecological Enhancement Land and Site respectively subject to the exceptions set out at Clause 6. 4.2 Without prejudice to the generality to clause 4.1 this Deed is further made pursuant to Sections 111 and 120 of the Local Government Act 1972 Section 2 of the Local Government Act 2000 and Section 1 Localism Act 2011 insofar as the same may be relevant to the enforcement of the obligations contained herein.
