This clause does not apply to: • employees terminated as a consequence of serious misconduct that justifies dismissal without notice; • probationary employees; • apprentices; • trainees; • employees engaged for a specific period of time or for a specified task or tasks; • casual employees; or • employees in New South Wales, Queensland and South Australia who are in receipt of the wage rates prescribed for metal trades employees engaged in on-site air conditioning work and on-site refrigeration work.
