Common use of EMPLOYEE BENEFIT PLAN DOCUMENTS Clause in Contracts

EMPLOYEE BENEFIT PLAN DOCUMENTS. In the event that any terms and provisions of this Agreement conflict with the terms and provisions of any employee benefit plan document, the terms and provisions of this Agreement shall govern, and the Company shall take any and all actions that may be necessary, including amendment of any plan document, to effect the provision of benefits expressly provided upon termination of the Executive’s employment pursuant to Sections 6 and 7.
