Emergency matters. Emergency matters may require immediate judicial action without compliance with this Section, and nothing in Part I.C.6.a-d. shall be construed as limiting a Party’s right to seek such relief when those emergency matters arise. However, the Parties shall make every reasonable effort to use the foregoing dispute resolution procedures prior to initiating judicial action, and the Party seeking immediate judicial relief shall have the burden of establishing the existence of an emergency.
