Common use of Eligible Tenderers Clause in Contracts

Eligible Tenderers. 2.1.1 A Tenderer is eligible to bid for a contract in procurement of listed products if the person satisfies the following criteria: a) The Tenderer has the legal capacity to enter, into a contract for procurement of the listed product. b) The Tenderer is not insolvent, in receivership, bankrupt or in the process of being wound up. c) The Tenderer, if a member of a regulated profession, has satisfied all the professional requirements. d) The Tenderer has fulfilled tax obligations. e) The Tenderer has not been convicted of corrupt or fraudulent practices and is not guilty of any serious violation of fair employment laws and practices.
