ELIGIBILITY FOR USE OF SICK LEAVE BANK Clause Samples
The "Eligibility for Use of Sick Leave Bank" clause defines the criteria an employee must meet to access and utilize days from a collective pool of sick leave. Typically, this clause outlines requirements such as minimum length of service, exhaustion of personal sick leave, or specific qualifying medical conditions before an employee can draw from the bank. Its core function is to ensure that only eligible employees can benefit from the shared resource, thereby preventing misuse and ensuring fair distribution of additional sick leave support during times of genuine need.
ELIGIBILITY FOR USE OF SICK LEAVE BANK. A member must meet all of the following requirements:
ELIGIBILITY FOR USE OF SICK LEAVE BANK. To be eligible to draw on the Sick Leave Bank, the following conditions must be met:
a. Employees become eligible for consideration beginning with their second school year of service.
b. The employee must have suffered a serious illness or injury which requires an extended absence. Prior to the serious illness, the employee must have not used fifty percent (50%) or more of their sick leave hours in the prior three (3) school years (or fewer if less than three [3] years with the District).
c. The employee must have exhausted his/her own reserve of sick and personal leave hours.
ELIGIBILITY FOR USE OF SICK LEAVE BANK. To be eligible to draw on the Sick Leave Bank, the following conditions must be met:
a. Employees become eligible for consideration beginning with their second school year of service.
b. The employee must have suffered a serious illness or injury which requires an extended absence. The Sick Leave Bank Committee shall consider the employee’s previous three (3) years’ use of sick leave in determining eligibility for Bank days.
c. The employee must have exhausted their own reserve of sick and personal leave hours.
d. The employee must apply to the Sick Bank Review Committee on the required form.
e. The Sick Leave Bank Review Committee may require a physician's report to accompany the application.
f. The employee must have contributed hours to the Sick Leave Bank.
