Common use of Elevation Clause in Contracts

Elevation. If the damaged or destroyed property is located within a 100-year floodplain or special flood area and the repairs are considered “substantial improvement,” (i.e. damages exceed 50% of the home’s pre-disaster value before repair or construction), Participant(s) must elevate the property to meet Federal floodplain requirements to receive Program funds. Replaced properties must be removed from the floodplain or raised two feet above the Base Flood Elevation (BFE), and meet National Flood Insurance Program (NFIP) minimum requirements and the current building code to qualify. If the Property is deemed in need of mandatory elevation, Participant(s) can receive an award for the elevation scope in addition to any CDBG-DR Program assistance provided for the replacement of the damaged or destroyed property.
