Elevation. Elevation is defined as restoring an employee to the higher classification, with permanent status, which was held prior to being granted a demotion or to a class that is between the current class and the class from which the employee was demoted. Upon elevation, an employee’s salary will be determined in the same manner that is provided for promotion in Section 43.5, above.

If the damaged or destroyed property is located within a 100-year floodplain or special flood area and the repairs are considered “substantial improvement,” (i.e. damages exceed 50% of the home’s pre-disaster value before repair or construction), Participant(s) must elevate the property to meet Federal floodplain requirements to receive Program funds. Replaced properties must be removed from the floodplain or raised two feet above the Base Flood Elevation (BFE), and meet National Flood Insurance Program (NFIP) minimum requirements and the current building code to qualify. If the Property is deemed in need of mandatory elevation, Participant(s) can receive an award for the elevation scope in addition to any CDBG-DR Program assistance provided for the replacement of the damaged or destroyed property.

The Financing Subsidiary shall pay any transfer fees and other expenses payable in connection with an Elevation and the Issuer will reimburse the Financing Subsidiary for half of such fees and expenses after receipt of an invoice therefor from the Financing Subsidiary detailing such amounts. The Issuer shall be responsible for any expenses of administering each Transferred Asset prior to its Elevation. At Elevation, the Financing Subsidiary shall deliver such assignment and the credit documentation with respect to the related Transferred Asset in its possession to or as directed by the Issuer. The Issuer and the Financing Subsidiary acknowledge and agree that, solely for administrative convenience, any transfer document or assignment agreement (or, in the case of any Underlying Instrument that is in the form of a note, any chain of endorsement) required to be executed and delivered in connection with the transfer of a Transferred Asset in accordance with the terms of any related Underlying Instruments may reflect that (i) the Financing Subsidiary is assigning such Transferred Asset directly to the Issuer or (ii) the Issuer is acquiring such Transferred Asset at the closing of such Transferred Asset. Elevation. (5) Geodetic control.
Elevation. If, at the end of the Meeting Period, the parties are unable to resolve the dispute, unless the parties agree in writing to extend the Meeting Period or one party declines to participate, the matter will be elevated to a representative of each party’s senior management, and the parties will attempt to resolve the dispute for an additional days.
