Electronic Logging Device Clause Samples
Electronic Logging Device. To serve Customers’ shipment-tracking demands and help fulfill government requirements, including compliance with the hours-of- service regulations, Contractor must maintain and operate in the Equipment, and Contractor’s driver will use, a Carrier-provided Electronic Logging Device (“ELD”). Carrier will, at ▇▇▇▇▇▇▇’s ex- pense, furnish, install, and maintain in an operable condition an ELD in the Equipment. Contractor will immediately return the ELD to Carrier upon ▇▇▇▇▇▇▇’s request or the termination of this Agree- ment. If the ELD is lost, damaged as a result of Contractor’s neg- ligence, or not returned upon request or upon termination of this Agreement, Contractor authorizes Carrier to deduct or otherwise recover the entire expense incurred by Carrier in recovering, re- pairing, or replacing the ELD. ▇▇▇▇▇▇▇ will not be responsible for any loss or damage to the Equipment arising or resulting from the installation, use, or removal of the ELD. If Contractor replaces the unit(s) of Equipment, Contractor will bear the expense of removal and re-installation of the ELD in the replacement Equipment, and Contractor authorizes Carrier to deduct or otherwise recover all such expense.
Electronic Logging Device. To serve CARRIER’s Customers’ shipment-tracking demands and fulfill government requirements, including compliance with the hours-of-service regulations, CONTRACTOR must maintain and operate in each power unit of Equipment as identified in Appendix G, and CONTRACTOR’s driver will use, an Electronic Logging Device (“ELD”). CONTRACTOR may either provide an ELD that is fully interoperable with CARRIER’s platform or elect to obtain one through CARRIER by making such an election in Section 5 of this Appendix F. If CONTRACTOR elects to obtain an ELD through CARRIER:
