Educational Functionality Sample Clauses
Educational Functionality. The Authority confirms that, as at the date of this Agreement, it has reviewed the Educational Functionality Information and that, subject to any qualifications and/or comments notified by the Authority to the Contractor in writing and set out in the Educational Functionality Information such proposals satisfy the Facilities Requirements in respect of Educational Functionality.
Educational Functionality. 10.3.1 The Authority confirms that it has reviewed the Contractor's Proposals and that the Contractor's Proposals meet the Facilities Requirements in the following respects:
10.3.1.1 the location of the buildings on the Sites;
10.3.1.2 the point of access to the Sites;
10.3.1.3 the points of access to the Buildings; and
10.3.1.4 the adjacencies between rooms and where relevant between departments within New Project Facilities; in each case, only so far as can reasonably be determined given the level of Design Data which has, at the Execution Date, been disclosed to the Authority.
10.3.2 However, the Authority's confirmation under Clause 10.3.1 shall not:
10.3.2.1 relieve the Contractor from its obligations to obtain and comply with the Necessary Consents, to provide the Services and to satisfy the Facilities Requirements in all respects other than those confirmed as meeting the Facilities Requirements in terms of Clause 10.3.1;
10.3.2.2 prejudice the Authority’s right to exercise or use any remedy available to the Authority under this Agreement;
