Common use of Education Act Clause in Contracts

Education Act. In the event that a full-time employee becomes a part-time employee as a result of a reduction of working hours by the Board, or as a result of the bumping procedure, the employee’s sick leave credits, and years of service for purposes of the retirement gratuity calculation, shall be frozen and protected for a period of three (3) years from the date that the employee became a part-time employee. In the event that the employee becomes a full-time employee within the three (3) year period, sick leave credits and years of service shall be reinstated. In the event that illness causes a full-time employee to become a part- time employee in lieu of retiring, due to illness, during the period of five (5) years prior to the employee’s normal retirement age, the employee’s sick leave credits and years of service, for purposes of the retirement gratuity calculation, shall be frozen and protected. The Board reserves the right to require satisfactory medical evidence of the illness. Where an employee has received sick benefits from the Board related to a non-occupational illness or injury, and subsequently receives a judgement or award from a third party for loss of wages relating to the same absence, the employee shall be required to pay to the Board the lesser of the amount of such award or the sick leave payments received.
