Common use of Earned Rest Clause in Contracts

Earned Rest. An employee who works in excess of sixteen (16) continuous hours, or in excess of sixteen (16) hours out of the preceding twenty-four (24) hours, without at least eight (8) continuous hours off, shall be entitled to a rest period of eight (8) continuous hours upon being released from duty. An employee will be paid his regular straight time rate for the time any rest period falls within his regularly scheduled work hours and will report to duty, unless properly excused at the conclusion of the rest period, if the rest period expires during his regularly scheduled hours. Following the rest period, the employee shall report for duty and be paid at his/her regular rate for the balance of the regularly scheduled work period.
