Common use of Early Implementation Clause in Contracts

Early Implementation. New Balance and Class Counsel are hereby authorized, and without requiring further approval of this Court – to implement the settlement before the Final Settlement Date (as defined in the Settlement Agreement), in which case all provisions in the Settlement Agreement specifying actions to be taken on or after the Final Settlement Date shall, to the extent necessary, be deemed to provide that those actions shall be taken on or after the date New Balance elects to implement the settlement.
