The E-MAIL USE clause defines the rules and limitations regarding the use of email communications between the parties involved in an agreement. E-MAIL USE. UAW designated employee representatives may use their university e-mail account in accordance with applicable university policy regarding electronic mail/electronic communications.

UPTE designated employee representatives may use their University e-mail account for the purpose of conducting union business which is specifically authorized by Article 10 - Grievance Procedure. Such use shall also conform to and be in accordance with applicable University/Laboratory policy regarding electronic mail/electronic communications.

1.9.6 Limited use of an Avangrid e-mail account for personal purposes shall be regarded as acceptable provided that:
a. Use does not interfere with the normal performance of professional duties.
b. Messaging does not violate applicable laws, regulations, the Code of Ethics, or Avangrid policies.
c. Use is moderate both in terms of frequency and amount of memory and resources consumed.
1.9.7 Avangrid e-mails or messages containing company information/ data shall not be forwarded to external parties except where there is a specific business ‘need to know'.
1.9.8 Avangrid electronic messaging shall not be used for transmitting, retrieving or storing any messages, files or attachments which constitute:
a. Harassing or discriminatory messages which relate to gender, race, sexual orientation, religion, disability or other characteristics protected by applicable laws and regulations.
b. Defamatory messages which adversely affect the reputation of a person or company.
c. Messages that violate copyright, trademark, trade secret or other intellectual property rights.
d. Obscene materials or images of a sexual nature.
e. Files or documents of an indeterminate origin or that, for any reason, may include computer viruses or in any way breach the security systems of the company or the recipient of the file or document, or may damage their IT systems.
f. Any material or images that might reasonably be expected to cause personal offense to the recipient.
g. Messages in violation of applicable laws, regulations, the Code of Ethics, or Avangrid policies.
1.9.9 The retention period for e-mail messages shall be 18 months. Once the retention period has been reached, emails shall be automatically eliminated from the user's mailbox.

Further, the parties agree that time spent by County employees generating or responding to union notices or queries on the County e-mail system will be kept to a minimum. Customers may receive announcements from time to time from Farmers via e-mail regarding various aspects of the Service, including, without limitation, notices of feature upgrades or changes, Service-affecting issues or events, or special offers for Service users from Farmers’ distribution partners or other parties. Sending mass, unsolicited e-mail is prohibited. Farmers reserves the right, in its sole discretion, to determine whether such e-mail constitutes unsolicited messages or transmission. Farmers may also immediately terminate any account which it determines, in its sole discretion, is transmitting or is otherwise connected with any “spam” or other unsolicited bulk e-mail. If actual damages cannot be reasonably calculated or quantified, Farmers may seek liquidated damages of five dollars ($5.00) for each piece of “spam” or unsolicited bulk e-mail transmitted from or otherwise connected with your account. Farmers is not responsible for deleting or forwarding any e-mail sent to the wrong e-mail address by you or by someone else trying to send e-mail to you. Farmers is also not responsible for forwarding e-mail sent to any account that has been suspended or terminated. This e-mail will be returned to the sender, ignored, deleted, or stored temporarily, at Farmers’ sole discretion. In the event that Farmers believes, in its sole discretion, that any Customer name, account name or e-mail address (collectively, an “identifier”) on the Service may be used for, or is being used for, any misleading, fraudulent or other improper or illegal purpose, Farmers (i) reserves the right to block access to and prevent the use of any of these identifiers and (ii) may at any time require any Customer to change his or her identifier.
