Division Chief. If the grievant is not satisfied with the response received in Step 1, the grievant may pursue the matter by presenting the grievance to the proper Division-Chief within five (5) working days of receipt of the Step 1 answer. The division/chief shall respond in writing within five (5) working days following receipt of the grievance.
Division Chief. A. Within ten (10) business days from his/her receipt of the supervisor's written decision and using the returned original copy of the grievance form, the employee may appeal to the appropriate level of Management as previously indicated by the employee's Department Head. The Department Head has the authority to waive the middle Management level if such a level is not appropriate because of the size of his/her department.
B. Within ten (10) business days from receipt of the grievance, the middle Management representative shall give a written decision and the reasons therefore to the employee using the original copy of the grievance. Upon request, a copy of the decision will be given to the Union Representative.
Division Chief. Upon vacancy , up to one (I) Division Chief position may be filled by an internal candidate by appointment by the Department head pursuant to the criteria contained herein:
(a) The Department head shall only appoint a qualified internal candidate into the Division Chief position.
(b) For the purposes of this agreement "qualified internal candidate" shall be defined as the member being in "Good Standing"; actively functioning in the rank of Battalion Chief for a minimum of two (2) years; demonstrated competencies to function in the Battalion Chief rank as determined by the Chief; completion of the Battalion Chief Task Book

Division Chief.
