DIVER Clause Samples
DIVER. A Diver is a person who wears a type of diving gear which directly supplies him with com- pressed air or other gases for breathing purposes and who personally enters and descends below the sur- face of the water, or any liquid medium, to work at the ambient pressures encountered therein. For the purposes of this Agreement, a person working in a submerged one-atmosphere ▇▇▇▇/vehicle is considered a Diver.
DIVER. (a) An experienced diver will mean an employee who is certified as such. A Supervising Diver means an employee appointed to ensure that all diving operations under that employee‟s supervision are carried out in accordance with Regulations made pursuant to the Occupational Health, Safety and Welfare Act, 1986.
(b) An employee who is an experienced diver will, in addition to their ordinary classified rate, be paid an allowance of $34.52 per week.
(c) An employee who on any day performs work as a diver will in addition to their ordinary classified rate be paid an allowance as follows: Per Day $ If an experienced diver (in addition to the allowance prescribed in sub clause 9.1.10.5 (b) hereof) If a Supervising Diver (unless this employee dives on that day in which event entitlement will be to the rate for experienced diver only) $46.81 $25.25 with a minimum payment of such allowance for any dive as for one whole day. For this purpose of this sub clause performs work as a diver will mean performing any work as a diver which requires the use of breathing apparatus.
(d) An employee on any day who performs work as a Diver‟s Attendant will in addition to their ordinary classified rate be paid an allowance of The Diver‟s Attendant allowance will not be paid to an employee who is Supervising Diver on that day. The minimum allowance payable under this sub clause is for one whole day.
