Common use of DISTRICT’s Rights Cumulative Clause in Contracts

DISTRICT’s Rights Cumulative. These provisions are in addition to and not a limitation on any other rights or remedies available to the DISTRICT. In the event the Contract is terminated pursuant to this Section, the termination shall not affect or limit any rights or remedies of the DISTRICT against CONTRACTOR or the Surety. The rights and remedies of DISTRICT under this Section are in addition to, and not in lieu of, any other rights and remedies provided by law or otherwise under the Contract Documents. Any retention or payment of monies to CONTRACTOR by DISTRICT shall not be deemed to release CONTRACTOR or its Surety from any liability hereunder.
