Common use of District’s Continuing Obligation Clause in Contracts

District’s Continuing Obligation. Unless there has been damage, destruction, a Taking as described above, or the Contractor is in Default as indicated herein, the District shall continue to remain liable for the payments required pursuant to the Guaranteed Project Cost Provisions indicated in Exhibit C and those amounts shall be payable to Contractor at the time and in the manner as therein provided.

District’s Continuing Obligation. Unless there has been damage, destruction, a Taking as described above, or the Contractor Developer is in Default as indicated herein, the District shall continue to remain liable for the payments required pursuant to the Guaranteed Project Cost Provisions indicated in Exhibit C and those amounts shall be payable to Contractor Developer at the time and in the manner as therein provided.
