Distinct Services Clause Samples

The 'Distinct Services' clause defines and clarifies that certain services provided under an agreement are to be treated as separate and independent from one another. In practice, this means that each service is considered individually for purposes such as billing, performance obligations, or liability, rather than being bundled together as a single offering. For example, if a vendor provides both software development and ongoing maintenance, each would be addressed as a distinct service. This clause ensures that the rights and responsibilities related to each service are clearly delineated, reducing confusion and helping to allocate risk and accountability appropriately between the parties.
Distinct Services. Distinct Services shall provide specially designed instruction to students who would benefit from a curriculum which differs significantly from the general education curriculum. These services may include academic, communication, life and functional skill components. These students benefit from spending a majority of their instructional time in a smaller group setting as their least restrictive environment. Students at all grade levels have a right to these services. Distinct Services will be staffed at a ratio of 7:1:2.
Distinct Services. The services are separate and apart from any other charges that may be assessed by your wireless carrier for text messages sent to or received from AmBank. You are responsible for any fees or other charges that your wireless carrier may charge for any related data or message services, including without limitation for short message service. You must provide source indication in any messages you send (e.g., mobile telephone number, "From" field in text message, etc.).
