Common use of Disposal of Machines Clause in Contracts

Disposal of Machines. 3.5.1 As from the effective date in Customer’s country of local laws and regulations implementing Directive 2002/96/EC of the European Parliament and of the Council of 27 January 2003 on waste electrical and electronic equipment (WEEE), the following will apply: when any Machine supplied under this Agreement replaces a machine put on the market before August 13, 2005, then IBM will collect and dispose of such replaced machine provided that IBM is required to do so by applicable law. IBM may charge for such collection and disposal to the extent permitted by applicable law.
