Common use of Disclosure of Individually Identifiable Health Information Clause in Contracts

Disclosure of Individually Identifiable Health Information. Both parties agree to the additional limitations and conditions set forth in the HIPAA Agreement set forth in Article VIII with respect to Covered Individuals’ protected health information, as such term is defined in HIPAA, created or received by BCBSRI or TPA while performing services under this Agreement. If there is a conflict between this Agreement and the HIPAA Agreement, the HIPAA Agreement will control, but only with respect to the subject matter of the HIPAA Agreement.
