Disabled Returning Veterans Clause Samples

The "Disabled Returning Veterans" clause establishes specific rights or accommodations for veterans with disabilities who are returning to a workplace or educational institution. Typically, this clause outlines the employer's or institution's obligations to provide reasonable adjustments, such as modified work duties, accessible facilities, or flexible schedules, to support the reintegration of disabled veterans. Its core function is to ensure that disabled veterans are not disadvantaged upon their return and to promote equal opportunity and compliance with relevant disability and veterans' rights laws.
Disabled Returning Veterans. Any employee entitled to reinstatement under this Section and who returns with service-connected disability incurred during the course of his/her service shall be assigned to any vacancy which shall be suitable to such impaired condition during the continuance of such disability irrespective of seniority; provided, however, that such impairment is of such a nature as to render the veteran’s returning to his/her own job or department onerous or impossible; and provided further that the veteran meets the minimum physical requirements for the job available or for the job as Management may be able to adjust it to meet the veteran’s impairment.
Disabled Returning Veterans. Any Employee entitled to reemployment under this Section who returns with a service-connected disability which makes returning to his/her prior job onerous or impossible shall be provided a reasonable accommodation on that job, or be assigned to an existing vacancy for which s/he is qualified (with a reasonable accommodation if needed) during the continuance of such disability.
