Common use of Disability Definition Clause in Contracts

Disability Definition. Executive shall be deemed to have become "Disabled" for purposes of this Agreement if, during the term of this Agreement, because of ill health, physical or mental disability or for other causes beyond his control he shall have been unable or unwilling or shall have failed to perform his duties hereunder, as determined by the written opinion of an independent medical physician designated by Employer and reasonably acceptable to Executive.
