Digital Accessibility. Suppler acknowledges and warrants that all digital content and services provided under this contract conforms and shall continue to conform during the Term of this Agreement to the W3C Web Content Accessibility Guidelines, version 2.0 (“WCAG 2.0”) at conformance Level A and AA. If all digital content and services does not fully conform to WCAG 2.0 A and AA, Supplier shall advise Pinellas County in writing of the nonconformance prior to execution of this Agreement and shall provide Pinellas County a plan to achieve conformance to WCAG 2.0 A and AA, including but not limited to, an intended timeline for conformance. Failure to achieve conformance, as determined in Pinellas County’s sole discretion, on its intended timeline shall be considered a material breach of this Agreement and grounds for termination by Pinellas County. If during the Term of this Agreement, Supplier fails to maintain compliance with WCAG 2.0 A and AA or Pinellas County otherwise identifies an issue related to accessibility of the product (the “Accessibility Issue”) that renders the product inaccessible, then Pinellas County shall notify Supplier of non-compliance. Within 30 days of Supplier’s receipt of a non-compliance notice (“Notice”), Supplier and Pinellas County shall meet and mutually agree upon an appropriate timeline for resolution of the Accessibility Issue(s) (“Initial Meeting”).
Digital Accessibility. For contracts involving website services, software or software as a service, or similar products or services, Entity represents and warrants that it will comply with all of its obligations under applicable federal disabilities laws and regulations, including without limitation the accessibility requirements of Section 508 of the Rehabilitation Act of 1973. Upon request by the University, Entity will provide a voluntary product assessment template (VPAT) regarding the compliance of the software applications and/or services provided by Entity. Entity agrees to promptly respond to, resolve and remediate any complaint regarding accessibility of its products or services in a timely manner and to implement changes Entity deems reasonable in response to any complaints. Entity will provide an updated version to University at no cost within a commercially reasonable time. These warranties shall not apply if the software applications and/or services are: (a) modified or altered in any way (other than by Entity or with the specific prior written consent of Entity); (b) not updated with the patches, fixes, updates, improvements, or enhancements that Entity may make available from time to time; (c) used in any manner or for any purpose not specifically permitted by this Agreement or the documentation.
Digital Accessibility. Contractor shall be responsible for ensuring that all deliverables, work, services, or equipment developed, designed, constructed or produced pursuant to this Agreement comply with Colorado law governing digital accessibility, including but not necessarily limited to at a minimum conforming with the current Web Content Accessibility Guidelines (“WCAG”) followed by the State of Colorado. To the extent any deliverables, work, services, or equipment developed, designed, constructed or produced pursuant to this Agreement fail to comply with the requirements of this Section, Contractor releases, defends, indemnifies and holds harmless Town, its officers, agents, and employees from any and all claims, damages, suits, costs, expenses, liabilities actions or proceedings of any kind or nature whatsoever, of or by anyone whomsoever, in any way resulting from, or arising out of, directly or indirectly, said failure. These defense and indemnification obligations shall survive the expiration or termination of this Agreement.
Digital Accessibility. As of the effective date of this Agreement, the Subscribed Products will conform to the completed Voluntary Product Accessibility Template (“VPAT”), provided to the Subscriber, which details features of the Subscribed Products that support compliance with the federal Section 508 standards for accessibility. Elsevier agrees to work in good faith to assist the Subscriber in responding to specific additional requests for accessibility or an accommodation for any Subscribed Products in order to allow Authorized Users with disabilities to access the Subscribed Products, provided that any adaptations of the Subscribed Products requested would not result in prohibitive expense or significant difficulty to Elsevier or be otherwise impractical.

  • Accessibility Supplier warrants that all Products will meet the requirements set forth in all federal, state, local and foreign laws, rules, and regulations applicable to accessibility of information technology for people with disabilities. Supplier agrees to use personnel trained and knowledgeable in supporting the needs of persons with disabilities in performance of Services under this Order.

  • System Access Control Data processing systems used to provide the Cloud Service must be prevented from being used without authorization.

  • Accessibility Requirements Under Tex. Gov’t Code Chapter 2054, Subchapter M, and implementing rules of the Texas Department of Information Resources, the System Agency must procure Products and services that comply with the Accessibility Standards when those Products are available in the commercial marketplace or when those Products are developed in response to a procurement solicitation. Accordingly, Grantee must provide electronic and information resources and associated Product documentation and technical support that comply with the Accessibility Standards.
