Developer's Right to Develop. Notwithstanding anything herein contained to the contrary, the Declarant hereby reserves unto itself, and for its successors and assigns, the right and option to control any access to the Project and to leave any controlled access in an open position for the unobstructed and uncontrolled passage of construction personnel and equipment engaged for or used in infrastructure and building construction activities.
