Common use of Developer's Product Clause in Contracts

Developer's Product. If Developer's Product as defined on Exhibit A is a computer program and not a hardware product, then Developer agrees that the Developer's Product into which the Executable Files are incorporated will include software supplied 3 by Developer which, by an objective examination of features and functions, represents a significant enhancement and transformation of the Licensed Software and results in a product substantially different from the Licensed Software. Developer further agrees that it will not use any Licensed Software for the purpose of developing, or incorporate the Licensed Software into, development systems for developing applications which use the LONTALK Protocol.
