Common use of Determination of Illness or Incapacity Clause in Contracts

Determination of Illness or Incapacity. For purposes of this Article V, the term "illness or incapacity" shall mean Employee's inability to perform his duties hereunder substantially on a full-time basis due to physical or mental illness as determined by the Board of Directors, in its reasonable discretion based upon competent medical evidence. Upon the Company's written request, Employee shall submit to reasonable medical and other examinations to provide the evidence required hereunder.

Determination of Illness or Incapacity. For purposes of this Article V, the term "“illness or incapacity" ” shall mean Employee's Executive’s inability to perform his duties hereunder substantially on a full-time basis due to because of physical or mental illness or physical injury as determined by the Board of Directors, in its reasonable discretion based upon competent medical evidence. Upon the Company's ’s written request, Employee Executive shall submit to reasonable medical and other examinations to provide the evidence required hereunder.

Upon Company and the Company's written request, Employee shall submit to reasonable medical and other examinations to provide the evidence required hereunderEmployee.

Upon the Company's written request, Employee shall submit to reasonable medical and other examinations to provide the evidence required hereunderdocumentation of same.

Upon the CompanyCompany and acceptable to Physician or Physician's written request, Employee shall submit to reasonable medical and other examinations to provide the evidence required hereunderdesignated proxy.

For purposes of this Article VVI, the term "illness or incapacity" shall mean EmployeeEMPLOYEE's inability to perform his EMPLOYEE's duties hereunder substantially on a full-time basis due to because of physical or mental illness or physical injury as determined by the Board of Directors, in its reasonable discretion based upon competent medical evidence. Upon the CompanyTHE COMPANY's written request, Employee EMPLOYEE shall submit to reasonable medical and other examinations to provide the evidence required hereunder.
