Common use of Designation of Applicable Courts and Jurisdictions Clause in Contracts

Designation of Applicable Courts and Jurisdictions. Each Tribal Party hereby irrevocably consents to the following courts, jurisdictions and venues for the judicial actions described in Section 15.1 above (the "Applicable Courts"): (a) the United States District Court for the Southern District of New York, and all courts to which any appeal therefrom may be available; (b) any court of the State of New York, and all courts to which any appeal therefrom may be available; (c) if none of the foregoing courts shall have or accept jurisdiction, then any other federal or state court, and all courts to which any appeal therefrom may be available; and (d) if none of the foregoing courts shall have or accept jurisdiction, then any court of the Tribe (in the case of any Permitted Claim to which the Tribe or the Authority is a party).

Each Tribal Chukchansi Party hereby irrevocably consents to the following courts, jurisdictions and venues for the judicial actions described in Section 15.1 10(e) above (the "Applicable Courts"): (ai) the United States District Court for the Southern District of New York, and all courts to which any appeal therefrom may be available; (bii) any court of the State of New York, and all courts to which any appeal therefrom may be available; (ciii) if none of the foregoing courts shall have or accept jurisdiction, then any other federal or state court, and all courts to which any appeal therefrom may be available; , and (div) if none of the foregoing courts shall have or accept jurisdiction, then any court of the Tribe (in the case of any Permitted Claim to which the Tribe or the Authority is a party).

Each of the Tribal Party Parties hereby irrevocably consents to the following courts, jurisdictions and venues for the judicial actions described in Section 15.1 10.01 above (the "“Applicable Courts"”): (a) the United States District Court for the Southern District of New York, and all courts to which any appeal therefrom may be available; (b) or if those courts lack jurisdiction over the action, any court of the State of New York sitting in the City of New York, and all courts to which any appeal therefrom may be available; (c) if none of the foregoing courts shall have or accept jurisdiction, then any other federal or state courtthe courts of the State of California, and all courts to which any appeal therefrom may be available; available and (d) if none of the foregoing courts shall have or accept jurisdiction, then any court of the Tribe (in the case of any Permitted Claim to which the Tribe or the Authority is a party).
