Common use of Design Rights Clause in Contracts

Design Rights. 15.1 For equipment, as listed at Annex E, which was originally developed by the Contractor under a Government Contract, the same conditions as were included in the original development Contract in respect of design rights shall apply to the results of the work performed under this Contract. 15.2 For equipment, as listed at Annex E, which was originally developed by a Government Department or a third party, subject to the rights of third parties and to the rights of the Crown, all rights in the work performed under this EC shall belong to the Authority. 15.3 For the equipment, as listed at Annex E, which was originally developed by the Contractor as a private venture, the design in the modified element of any sub-unit or component provided under this Contract (hereinafter referred to as the modified design) shall be subject to DEFCON 15.
