Derivative Use. Total or partial use of a recording for purposes other than those set forth and defined in this agreement. 1-2. 00 Responsibilities of the parties 1-2.01 The performers shall comply with the producer’s production policy. The producer shall, in turn, respect the performers’ religious, political and moral principles. 1-2.02 The producer shall be held accountable for his choice of performers. 1-2.03 The performers’ conduct shall be beyond reproach throughout the performance of their contract and the UDA shall be held accountable therefore. 1-2.04 Except for the duration of engagements already made, when so notified in writing, the producer shall not retain the services of a performer who has been suspended or expelled from the ranks of the UDA. 1-2.05 Subject to clause 1-2.04, a performer shall refuse to work with anyone who is not a member in good standing of the UDA. 1-2.06 The producer shall see to it that the performers are treated civilly, are given decent accommodations and travel in safety. He shall also see to it that their personal belongings and clothing can be stored safely. 1-2.07 The producer shall assume responsibility for the legal fees and judgements to which a performer is exposed by virtue of his contract, provided the performer gives him sufficient notice thereof. The producer shall be released from this responsibility if he can establish that the performer failed to abide by the contract provisions or producer’s written instructions. In case of out-of-court settlement, the provisions of this clause shall apply in the same way to the incurred fees, capital and interest. 1-2.08 The RPM and the UDA agree to inform the Joint Committee of any situation not explicitly covered by this agreement. Any use of a recording other than those provided for herein, must be agreed upon beforehand with the Joint Committee. 1-2.09 Members shall neither undertake nor continue to work for a producer not in good standing. The UDA’s Ethics Committee shall be informed of any performer contravening the stipulations in the foregoing paragraph. 1-2.10 Regarding psychological harassment The producer undertakes to respect the laws and regulations applicable to psychological harassment. The producer shall take reasonable steps to prevent psychological harassment and, where such conduct is brought to his attention, to stop it. 1-3. 00 Calculation of deadlines 1-3.01 Holidays shall be included in the calculation of deadlines. 1-3.02 If a deadline falls on a Saturday, Sunday or holiday mentioned in 6-3.01, it shall be extended to the following business day. 2-1.01 This collective agreement applies to all persons hired or used by the producer in a function covered by the recognition granted to the UDA by the Commission des relations du travail and whose certificates are reproduced in Appendix E of this collective agreement, as well as any other function defined in this collective agreement. The fact that a performer gives a performance pursuant to this collective agreement through a commercial entity or a legal person does prevent the application of this agreement. 2-2. 00 Exceptions to the application of the collective agreement 2-2.01 a) a director or assistant director who, owing to skills acquired through experience or as part of his profession, performs the role of commentator. He may also perform the role of cue person at an audition; b) a person who, owing to skills acquired through his experience or as part of his profession, participates in a recording as commentator, speaker, demonstrator, interviewer or interviewee and whose participation is limited to the demonstration, explanation or performance of his work or usual professional activity; c) a person who, in a recording, has a personal appearance or carries out the normal duties of his position or profession; d) a person who appears by pure chance in a recording; e) a person unknown to the general public who gives a testimonial as a consumer of the product or service which is the subject of the commissioned work; f) a person who gives a testimonial as an employee of the organization and whose testimonial relates to his employer or to the quality of the products or services offered by his employer; g) an employee of a producer that is not a UDA member, who records test voices for technical purposes that will not be used in the final version of the recording; h) a person who participates in a recording produced as part of a training exercise and solely used internally to evaluate participants, and this on condition that no UDA member participates. i) a director who, owing to skills acquired through experience or as part of his profession, performs the role of choreographer. CHAPTER 3-0.00 – SPECIAL PROVISIONS CONCERNING The use of recordings produced prior to the application of this agreement remains subject to the agreements or regulations governing such recordings at the time they were made.
