Common use of Depository is Registered Holder Clause in Contracts

Depository is Registered Holder. For the purposes of these Series AO Preferred Share provisions, as long as the Depository, or its nominee, is the registered Holder of the Series AO Preferred Shares, the Depository, or its nominee, as the case may be, will be considered the sole Holder of the Series AO Preferred Shares for the purpose of receiving notices or payments on or in respect of the Series AO Preferred Shares, including payments of Series AO Dividends, the Redemption Price or Accrued and Unpaid Dividends on the Series AO Preferred Shares, and the delivery of Series AP Preferred Shares and certificates for those shares on the conversion into Series AP Preferred Shares.
