Dependence on Performance by Others. The obligation of FDMS to timely perform the Services is expressly subject to the timely performance by Customer, and third party vendors Customer engages, of their obligations and responsibilities, but only to the extent that failure to so perform directly affects FDMS's ability to timely perform hereunder or the cost to FDMS of performing hereunder.
