Common use of Deliverables Liquidated Damages Clause in Contracts

Deliverables Liquidated Damages. The Design-Builder acknowledges that the Department is engaging the Design-Builder to provide an extensive level of preconstruction support services to minimize the potential for cost overruns, schedule delays or the need for extensive Value Engineering/re- design late in the Project and that the deliverables required under this Section 3.1.1 are key to identify the value of such services. In the event the Design-Builder fails to deliver any of the deliverables required in Section 3.1.1 (and unless such failure is the result of any event of Force Majeure), the Design-Builder shall be subject to liquidated damages in an amount of Five Thousand Dollars ($5,000) plus Five Hundred Dollars ($500) per day after receiving written notice from either the COTR or the Contracting Officer of failure to submit such deliverables.
