Common use of Delay beyond five month Clause in Contracts

Delay beyond five month. In case the commissioning of Project is delayed beyond 5 months, the SPD shall, in addition to encashment of Bank Guarantee, pay to NTPC the Liquidated Damages @ Rs. 1,00,000 per MW per day of delay for the delay in such remaining Capacity which is not commissioned. The amount of liquidated damages would be recovered from the SPD from the payments due on account of sale of solar power to NTPC in thirty (30) equal monthly instalments from first billing cycle.
