Common use of Definitive Agreement Clause in Contracts

Definitive Agreement. Customer’s substitution right and Boeing’s obligation in this Letter Agreement are further conditioned upon Customer’s and Boeing’s executing a definitive agreement for the purchase of the Substitute Aircraft within thirty (30) days of Customer’s substitution notice to Boeing or of Customer’s acceptance of an alternate delivery month in accordance with paragraph 2, above.

Definitive Agreement. Customer’s substitution right and Boeing’s Boeing obligation in this Letter Agreement are further conditioned upon Customer’s Customer and Boeing’s executing a definitive agreement for the purchase of the Substitute Aircraft within thirty (30) days of Customer’s substitution notice to Boeing or of Customer’s acceptance of an alternate delivery month in accordance with paragraph 2, 2 above.

Upon definitive agreement, abovesuch Substitute Aircraft shall be incorporated into the Agreement as Aircraft.

Definitive Agreement. Customer’s substitution right and Boeing’s obligation in this Letter Agreement are further conditioned upon Customer’s and Boeing’s executing a definitive agreement for the purchase of the Substitute Aircraft within thirty (30) days of Customer’s substitution receipt of a draft of such definitive agreement. Boeing shall provide Customer with a draft of the definitive agreement as soon as reasonably practicable following receipt of Customer’s notice to Boeing or of intent or, as the case may be, Customer’s acceptance of an alternate alternative delivery month month. The parties shall negotiate the definitive agreement in accordance with paragraph 2, abovegood faith.
