Deduction for Use Clause Samples

The 'Deduction for Use' clause establishes a mechanism for reducing the amount owed or payable under a contract to account for the value derived from the use of goods, services, or property during a specific period. In practice, this clause typically applies when a party has had the benefit of using an asset or service before its return, replacement, or the resolution of a dispute, and the deduction reflects the fair value of that use. Its core function is to ensure fairness by preventing unjust enrichment and accurately reflecting the benefit received, thereby resolving potential disputes over compensation or refunds.
