A Declaration of Availability Timelines clause establishes the specific periods within which a party must confirm the availability of resources, personnel, or deliverables required under the agreement. Typically, this clause requires one party to notify the other of their readiness or ability to perform certain obligations by a set deadline, such as confirming staff availability for a project phase or the delivery window for goods. Its core function is to ensure both parties have clear expectations regarding scheduling, thereby reducing the risk of delays and misunderstandings related to resource allocation or project timelines.
Declaration of availability timelines. Prior to March 1st casual employees shall declare which eight (8) weeks they are available for between June 15th and September 15th, as well as which Statutory Holidays they are available for between June 1st and December 1st. Prior to October 1st, casual employees shall declare which five (5) dates they are available between the December 23rd to January 3rd Christmas Holiday period, as well as which Statutory Holidays theyare available for between December 1st and May 31st. Amendments to availability submitted less than two (2) weeks prior to the posting of the schedule may not be considered. Such request must be submitted in writing. Casual employees are available for call ins as circumstances demand. Where a casual employee fails to meet any of the requirements described above, or refuses six consecutive offers of work, the Hospital shall forward a letter to his last address on record with the Hospital, with a copy to the Union, in order to advise the employee of his obligations under this provision and instructing him to contact the Hospital within ten (10) days of receipt of the letter for the purpose of declaring his availability as described above. Failure by the employee to comply shall result in termination. Such shall not be grievable or arbitrable. A casual employee who would otherwise be terminated for reason of permanent lack of work, where he/she so requests, will be provided with an opportunity to obtain continued employment as a casual employee, where the Hospital requires casual employees, and where the casual employee who would otherwise be terminated possesses the required skills and abilities to perform the work required. Where no such opportunity arises, the casual employee may be terminated by the Hospital. Such termination shall not be grievable or arbitrable.

  • SUBMISSION OF THE MONTHLY MI REPORT 4.1 The completed MI Report shall be completed electronically and returned to the Authority by uploading the electronic MI Report computer file to MISO in accordance with the instructions provided in MISO. 4.2 The Authority reserves the right (acting reasonably) to specify that the MI Report be submitted by the Supplier using an alternative communication to that specified in paragraph 4.1 above such as email.   • Unavailability of Tenor of Benchmark Notwithstanding anything to the contrary herein or in any other Loan Document, at any time (including in connection with the implementation of a Benchmark Replacement), (i) if the then-current Benchmark is a term rate (including the Term SOFR Reference Rate) and either (A) any tenor for such Benchmark is not displayed on a screen or other information service that publishes such rate from time to time as selected by the Administrative Agent in its reasonable discretion or (B) the regulatory supervisor for the administrator of such ▇▇▇▇▇▇▇▇▇ has provided a public statement or publication of information announcing that any tenor for such Benchmark is not or will not be representative, then the Administrative Agent may modify the definition of “Interest Period” (or any similar or analogous definition) for any Benchmark settings at or after such time to remove such unavailable or non-representative tenor and (ii) if a tenor that was removed pursuant to clause (i) above either (A) is subsequently displayed on a screen or information service for a Benchmark (including a Benchmark Replacement) or (B) is not, or is no longer, subject to an announcement that it is not or will not be representative for a Benchmark (including a Benchmark Replacement), then the Administrative Agent may modify the definition of “Interest Period” (or any similar or analogous definition) for all Benchmark settings at or after such time to reinstate such previously removed tenor.

  • RDO Schedule/ Working Day Calendar (a) The Employer recognises that hours accrued in accordance with clause 38 create a bank of hours to be drawn upon by the Employee, as a paid RDO. The Employer recognises that Employees are entitled to take off days accrued in accordance with this clause. (b) The agreed indicative RDO/Working Day Calendars for 2024 to 2029 are attached at Appendix D of this Agreement. (c) For the avoidance of doubt, nothing in the arrangement for an indicative RDO / Working Day Calendar is intended to impose a limit on the ability of the Employer to determine with its Employees when and where work can be performed to meet operational requirements or otherwise limit the Employer’s right to manage its business and improve productivity.

  • Reports of unusual occurrence The Contractor shall, during the Maintenance Period, prior to the close of each day, send to the Authority and the Authority’s Engineer, by facsimile or e- mail, a report stating accidents and unusual occurrences on the Project Highway relating to the safety and security of the Users and Project Highway. A monthly summary of such reports shall also be sent within 3 (three) business days of the closing of month. For the purposes of this Clause 15.4, accidents and unusual occurrences on the Project Highway shall include: (a) accident, death or severe injury to any person; (b) damaged or dislodged fixed equipment; (c) flooding of Project Highway; and (d) any other unusual occurrence.
