Debarrment. RPI warrants and represents that it is not debarred under subsection 306 (a) or (b) of the Federal Food, Drug and Cosmetics Act (U.S. Generic Drug Enforcement Act of 1992: 21 USC 335a(a) or (b)) and that to the best of its knowledge and belief it will not use in a capacity the services of any person debarred under such law with respect to services performed under this Agreement and that it will amend certification in light of new information.
Debarrment. Neither STRATEC nor any of STRATEC’s personnel performing Development Services under this Agreement have been debarred, and to the best of STRATEC’s knowledge, are not under consideration to be debarred, by the a Federal agency of the United States of America from working in or providing services to any pharmaceutical or biotechnology company under the Generic Drug Enforcement Act of 1992. STRATEC shall not knowingly employ or contract with any individual or entity listed by a Federal agency of the United States of America as debarred.
Debarrment. 13. BROOKWOOD warrants and represents that it: (a) has not been, or is not currently, an individual, corporation, partnership, association or entity that has been debarred by the U.S. Food and Drug Administration (“FDA”) pursuant to 21 U.S.C. §335 (a) or (b); (b) has not been convicted of or pled guilty or no contest to a crime; or (c) has not been sanctioned by a federal or state law enforcement, regulatory or licensing agency. BROOKWOOD has no knowledge of any circumstances which may affect the accuracy of the foregoing representations.
Debarrment. Consultant represents and warrants that he/she is not debarred from consideration for contract awards by the Director of the Department of Administrative Services, pursuant to either R.C. 153.02 or R.C. 125.25. If this representation and warranty is found to be false, this Agreement is void ab initio and Consultant shall immediately repay to the College Foundation any funds paid under this Agreement.
Debarrment. Xx. Xxxxxxxxx represents, warrants and covenants that he is not now nor has in the past been debarred by the United States Food and Drug Administration under the Food, Drug and Cosmetic Act or under the Generic Drug Enforcement Act and the Employee has never been convicted under the Food, Drug and Cosmetic Act or under the Generic Drug Enforcement Act, or under any other federal law for conduct relating to the development or approval of a drug product and/or relating to a drug product.
Debarrment. ImmunoGen shall not employ, contract with or retain any person, directly or indirectly, to perform any services under this Section 4 if such person is debarred by the FDA under 21 U.S.C. § 335a. Upon written request from Centocor, ImmunoGen shall, within [***********] days, provide written confirmation that it has complied with the foregoing obligation.
Debarrment. None of Organichem's officers, directors, employees, and/or agents is debarred or otherwise excluded under sections 306(a) and (b) of the FD&C Act, and no individual associated with the development or manufacture of the API shall have been debarred or otherwise excluded under sections 306(a) and (b) of the FD&C Act
Debarrment. None of Purepac's officers, directors, employees, and/or agents is debarred or otherwise excluded under sections 306(a) and (b) of the FD&C Act and no individual associated with the distribution or sale of the Commercial Product shall have been debarred or otherwise excluded under sections 306(a) and (b) of the FD&C Act.
Debarrment. Patheon covenants, represents and warrants that it is not debarred and has not knowingly used in any capacity the services of any person debarred under Section 306(a) or (b) of the Federal Food, Drug and Cosmetic Act as amended, as each may be amended from time to time.
Debarrment. PURCHASER is not currently excluded, debarred, suspended or otherwise ineligible to participate in US Federal health care programs or in US Federal procurement or nonprocurement programs.
