Common use of DBE Program Requirements Clause in Contracts

DBE Program Requirements. (a) The Contractor shall utilize the specific DBEs listed to perform the work and supply the materials for which each is listed in Schedule C of Subcontractor Participation form unless the contractor obtains the prior written consent of the Authority upon a showing of good cause as established by 49 C.F.R. Section 26.53 (f)(3). Contractor will not be entitled to payment for any work or materials unless it is supplied by the listed DBE. (b) Unless such consent is obtained, the contractor shall not be entitled to any payment for work or material unless it is performed or supplied by the listed DBE. (c) At no time will the contractor invoice the Authority for amounts pertaining to subcontractors terminated or substi- tuted without prior approval of the Authority.
