Data Protection Act 2018 (the. “DPA”) It is the responsibility of all signatories to this Agreement to ensure that information exchanges are justified by, and in accordance with the DPA. The DPA acts as a framework for how to handle and process (including sharing, obtaining, recording and storing) personal and special category personal information. It contains two Schedules that list various Conditions which, when fulfilled, allow for the processing of personal data (Schedule 1) and special category data (Schedule 8). Personal data is that which can identify a living individual. Some personal data is classified as special category personal data when it relates to a person's racial or ethnic origins, physical or mental health or conditions, sexual life, criminal offences, religious beliefs and trade union membership. The 6 Data Protection Principles also need to be complied with to allow sharing to be lawful. (The 6 Data Protection Principles are listed in Appendix H)
