The DATA AND FACILITIES clause defines the obligations of the parties regarding the provision and use of data, information, and physical or digital resources necessary for the performance of a contract. DATA AND FACILITIES. Contractor acknowledges that it has in its possession all applicable specifications and drawings and all other documents to which reference is made herein and/or which are matched hereto, and all such data are adequate to enable Contractor to fairly determine its ability to perform the work called for herein at the price and in accordance with the schedule set forth herein. Contractor represents that it now has or can readily procure, without assistance of City, all facilities, machinery, and equipment necessary for the performance of this Agreement.

Contractor will work with City Departments to obtain, and City will provide, all applicable specifications and drawings, and all other documents including any available GIS data or other information showing locations of potential radio mounting assets (such as fiber routes, traffic signals, street lights and buildings) necessary for Contractor to incorporate into design of software and/or WiFi Network, Through previous project experience of similar nature, Contractor represents that it now has some of this information and/or can readily procure with limited assistance of the City, and will not rely on City machinery and equipment necessary for the performance of this Agreement.

Any discrepancies or questions shall be referred to Buyer for decision or interpretation.
