Cut-Off Levels Clause Samples

The Cut-Off Levels clause establishes specific thresholds or limits beyond which certain actions, obligations, or liabilities no longer apply within a contract. In practice, this might mean that a party is only responsible for losses, claims, or performance up to a predetermined amount or time, after which their responsibility ceases. This clause is essential for clearly defining the boundaries of contractual risk and responsibility, thereby preventing disputes over excessive or unforeseen liabilities.

Only tests which are positive pursuant to the SAMHSA standards shall be reported to the Medical Review Officer as positive. A .04 blood/alcohol level or above shall be considered to be positive.
