Customer Use Sample Clauses

Customer Use. Upon completion of training by Distributor to Customer, Customer shall become an authorized provider of Zeltiq Products and authorized to use the Zeltiq Marks solely in its promotion and delivery of services utilizing Zeltiq Products. Customer acknowledges Zeltiq’s exclusive ownership of the Zeltiq Marks and that its use thereof inures solely to Zeltiq’s benefit. Customer shall not attempt to obtain registration of any Zeltiq Xxxx, and shall not debrand, rebrand or private label any Zeltiq Product or service. Distributor shall have sole responsibility to notify Customer in writting of these terms upon Sale of Zeltiq Products. Distributor is required to notify Zeltiq immediately of any misuse or violation of Zeltiq Marks and its Products as defined within this Section. Any misuse or violation of this section may result in termination of Sale and/or forfeit of Product.

Customer Use. Customer acknowledges and agrees that BigRentz has no control over the manner in which Equipment is operated during the Actual Rental Period and that Equipment may be dangerous if used improperly or by untrained parties. Customer represents and warrants: (i) the delivery site will be reasonably accessible, safe, and secure, and that Equipment will be operated on a safe location with a solid and level surface; (ii) Equipment will not be subject to neglect, carelessness, misuse, or abuse, including but not limited to, being overloaded or taxed beyond its capacity (including rigging weight capacity limits) or be used for transportation, storage, use or removal of explosives or hazardous products or materials as may be defined by federal, state or local regulatory or enforcement agencies; (iii) Equipment will be: operated only by authorized individuals who are not under the influence of drugs or alcohol or otherwise impaired and who are properly trained and qualified to use Equipment; used with protective equipment according to legal and industry standards, and in a careful, proper and legal manner; used in compliance with all operational and safety instructions provided on, in or with Equipment, including the manufacturer’s specifications, and all federal, state and local laws, ordinances, rules, standards and regulations; and kept in a secure location. Customer acknowledges that Customer is solely responsible to obtain training that Customer desires or deems necessary prior to the use of Equipment and Customer disclaims any obligation or responsibility of BigRentz to Customer or any operator of Equipment. Equipment will not be used when overloaded, or to carry persons or property for hire; (iv) Customer will not allow the use of Equipment in any publication (print, in audiovisual or electronic); (v) Customer will pay for any fees for licenses, registrations, permits, and other certificates that may be required for the lawful operation of Equipment;
Customer Use. If permitted access to Veracity’s systems in order to maintain Service, Customer must comply with the following:
Customer Use. Records and data in the Starter Repository made available to any Customer under this Agreement are to be used by such Customer solely in accordance with the terms hereof.
Customer Use. Title Records made available to Customer under this Agreement are to be used by Customer solely for the purpose of conducting Title Searches of specific parcels of real property and examinations thereof in connection with bona fide Title Orders of Customer. Without limiting the generality of the foregoing, Customer agrees that access to the Title Records shall not be utilized by Customer or any of its employees for the purpose of furnishing any Title Record information to any other title insurance company, title company, or any person, firm or corporation except Customer and Customer's customers in the ordinary course of its business. However, Customer shall have the right to utilize the Title Records to furnish the usual customer service as to inquiry by customers of Customer as regards specific parcels of land or specific documents covered in such Title Records; provided that Customer shall not deliver a copy of any Starter (other than a Customer Starter) to any other person.
Customer Use. Customer will use the Services for its own internal business purposes and will not transfer, resell, license or otherwise make available the Services to third parties. Customer will use the Services as reasonably directed by Mimecast. Customer will allow only the number of Permitted Users shown in the applicable Services Order to access and use the Services.
Customer Use. Customer may use Precision eMail™ only in and for Customer’s own internal purposes and business operations. Customer may not use Precision eMail™ in any manner for any third party (other than for Customer’s customers as provided herein). No license or right to use, reproduce, translate, rearrange, modify, enhance, display, sell, lease, sublicense or otherwise distribute, transfer or dispose of Precision eMail™ accessed by Customer, in whole or in part, is granted, except as expressly provided in this Amendment. Customer shall not reverse engineer, decompile, or disassemble the Precision eMail™ application software. Nothing in this Agreement will entitle Customer to access or use the source code of Precision eMail™.

Customer Use. Customer may use the Services for any lawful purpose, provided that such purpose does not interfere with or impair service or the privacy of any communication over any of the facilities and equipment comprising the IdeaTek networks.
Customer Use. After Ask Jeeves approves a use of the Trademarks under the above subsection, Customer may use the Trademarks in the approved manner while this Agreement is in effect. Customer must obtain Ask Jeeves’ prior written approval for any change in use of the Trademarks.

Customer shall not interfere with other customers' use of the Equipment or Services or disrupt the Madison Network, backbone, nodes or other Services. Violation of any part of this Section is grounds for immediate Termination of this Agreement and/or all Service Orders in addition to any other rights or remedies Madison may have.
